1. Privacy Policy What information is collected, why it is needed, and what Xenodimensional Audio does not do with customer data.

1.1 Our approach to privacy

Xenodimensional Audio collects only the personal information reasonably required to process purchases, deliver products, provide customer support, maintain transaction records and meet our legal and accounting obligations.

We do not operate a customer-data business.

We do not sell, rent or trade customer information.

We do not provide customer information to third parties for advertising, profiling or third-party marketing.

Purchasing a Xenodimensional Audio product does not automatically enrol you in marketing communications.

1.2 Information we may collect

When you purchase or contact Xenodimensional Audio, information collected may include:

  • your name;
  • email address;
  • billing information required for the transaction;
  • country or region where required for taxation or payment processing;
  • products purchased;
  • purchase date and transaction details;
  • the operating system selected for your product download;
  • correspondence you send to us regarding purchases or technical support; and
  • basic technical information reasonably required to operate and secure the website.

We do not intentionally collect information that is unrelated to operating Xenodimensional Audio or supplying its products.

1.3 Payment information

Payments may be processed by third-party payment providers.

Xenodimensional Audio does not need or intend to directly store complete credit or debit card numbers where payment processing is performed by those providers.

Payment providers may collect and process information according to their own privacy policies and legal obligations.

1.4 How information is used

Customer information may be used only where reasonably necessary to:

  • process a purchase;
  • confirm payment;
  • deliver purchased software;
  • provide access to downloads;
  • issue receipts or invoices;
  • provide customer or technical support;
  • process refunds;
  • maintain accounting and taxation records;
  • prevent fraudulent or abusive transactions;
  • maintain the security and operation of the website; or
  • comply with applicable laws.

Customer information will not be used or supplied for unrelated third-party marketing purposes.

1.5 Third-party service providers

Some information may necessarily be processed by service providers used to operate the business, such as:

  • payment processors;
  • website and online-store providers;
  • web hosting providers;
  • email providers;
  • accounting services; and
  • professional advisers where reasonably necessary.

These disclosures are made only where reasonably required to operate the business, complete the transaction or comply with legal obligations.

They are not made for the purpose of selling or marketing customer information.

Some service providers may process or store information outside Australia.

1.6 Marketing

Xenodimensional Audio will not provide your personal information to another organisation for that organisation's marketing.

If Xenodimensional Audio offers an optional mailing list or newsletter, subscription will be voluntary and separate from purchasing a product.

You may unsubscribe from any such communication at any time.

Transaction emails, download information, receipts, important product notices and direct responses to support requests are not considered marketing communications.

1.7 Retention and security

Customer and transaction information is retained only for as long as reasonably required for the purposes for which it was collected, including taxation, accounting, legal, fraud-prevention and customer-support requirements.

Reasonable steps are taken to protect information against unauthorised access, disclosure, alteration or loss.

No internet-based system can be guaranteed to be completely secure.

1.8 Access and correction

You may contact Xenodimensional Audio to request access to, or correction of, personal information we hold about you.

Where information must legally be retained as part of business, taxation or transaction records, it may not be possible to delete it immediately.

Privacy enquiries can be sent via the form on the contact page.

2. End User Licence Agreement (EULA) Your perpetual licence, installation rights, creative-use rights, ownership and permitted use.

2.1 Your licence

Purchasing a Xenodimensional Audio plugin gives you a perpetual licence to use that product as well as all updates for the version of that product.

The licence does not expire and is not a subscription.

Unless specifically stated otherwise for a particular product:

You may install and use the plugin on any number of computers that you personally own or control.

There is no per-machine licence limit.

You do not need to purchase an additional licence merely because you own multiple computers.

2.2 Personal and commercial use

You may use Xenodimensional Audio plugins for both personal and commercial creative work.

This includes, without limitation:

  • music production;
  • recording;
  • composition;
  • sound design;
  • film and television;
  • games;
  • live performance;
  • broadcast;
  • commissioned work; and
  • commercially released audio.

Xenodimensional Audio makes no claim to music, recordings, sounds or other creative works you produce using its plugins.

Your work is yours.

No royalty is payable to Xenodimensional Audio for creative work made using the software.

2.3 Internet connection

Unless expressly stated otherwise for a particular product, Xenodimensional Audio plugins do not require a continuous internet connection to operate.

Where a product is supplied as a conventional downloadable installer or plugin file, it may be installed and used locally on supported systems.

2.4 What you may not do

Purchasing a licence does not give you the right to:

  • distribute copies of the plugin to other people;
  • publicly upload or share the plugin installer or binary;
  • provide another person with your licence or account for the purpose of avoiding purchase;
  • sell unauthorised copies;
  • claim authorship or ownership of the plugin itself;
  • remove copyright, trade mark or ownership notices;
  • create or distribute an unauthorised modified commercial version of the plugin; or
  • use Xenodimensional Audio branding in a way that suggests an unauthorised product is an official Xenodimensional Audio product.

Nothing in this agreement restricts a right that cannot legally be restricted under applicable law.

2.5 Ownership

Purchasing a plugin gives you a licence to use the software.

It does not transfer ownership of the underlying software, source code, Xenodimensional Audio brand, product names, graphics or other intellectual property.

Those rights remain with Xenodimensional Audio and their respective rights holders where third-party components are used.

2.6 Updates

Xenodimensional Audio may provide updates, maintenance releases and bug fixes from time to time.

Unless specifically advertised as part of the purchase, the purchase of one version does not create an unlimited obligation for Xenodimensional Audio to develop new versions indefinitely or guarantee compatibility with future operating systems, DAWs, hardware or third-party software.

Where reasonably practical, Xenodimensional Audio intends to maintain currently supported products.

2.7 Licence termination

This licence remains in effect indefinitely unless it is materially breached.

A licence may be terminated where the software is deliberately pirated, redistributed or otherwise used in serious violation of this agreement.

Termination does not affect any rights a customer has under Australian Consumer Law.

3. Terms and Conditions of Sale Digital product terms, pricing, compatibility, availability and Australian Consumer Law.

3.1 Application

These terms apply to purchases made directly from Xenodimensional Audio.

By purchasing a product, you agree to these Terms and Conditions and the End User Licence Agreement above.

3.2 Digital products

Xenodimensional Audio plugins are digital software products supplied electronically.

No physical product will be supplied unless specifically stated otherwise.

3.3 Product information

We make reasonable efforts to accurately describe:

  • the purpose and features of each plugin;
  • supported plugin formats;
  • supported operating systems;
  • relevant system requirements; and
  • known material limitations.

Customers should review the product description and system requirements before purchase.

If you are unsure whether a plugin is compatible with your system, you are welcome to contact Xenodimensional Audio before purchasing.

3.4 Pricing

Prices are displayed in the currency indicated by the website at the time of purchase.

Applicable taxes, payment charges or currency conversions may be calculated during checkout where relevant.

Xenodimensional Audio may change product prices, offer discounts or run promotions at any time.

A later price reduction does not create an entitlement to a refund of the difference for an earlier purchase.

3.5 Free products

Products supplied free of charge may be subject to the same licence restrictions concerning redistribution, ownership and intellectual property unless otherwise stated.

No purchase price refund is available for a product supplied for no charge.

3.6 Availability

Xenodimensional Audio may update, replace, discontinue or withdraw products.

Customers who have already purchased a discontinued product retain their licence to copies of that product already lawfully obtained, subject to these terms.

Xenodimensional Audio cannot guarantee indefinite download hosting or compatibility with hardware, operating systems or software released after a product has been discontinued. Xenodimensional Audio will however make every reasonable attempt to ensure that purchased products will remain available for download.

Customers are therefore encouraged to retain backups of purchased installers.

3.7 Software compatibility

Computer audio systems involve combinations of operating systems, DAWs, plugin formats, audio hardware and other software outside Xenodimensional Audio's control.

We do not guarantee compatibility with every possible computer configuration.

Where specific compatibility or system requirements are advertised, the product should materially perform as described on systems meeting those requirements, subject to the consumer rights described below.

3.8 Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Where Australian Consumer Law provides a customer with rights exceeding these terms, those statutory rights prevail.

3.9 Limitation of liability

To the maximum extent permitted by law, Xenodimensional Audio is not liable for indirect or consequential losses arising from matters outside its reasonable control.

This clause does not exclude or restrict liability or remedies that cannot legally be excluded or restricted under Australian Consumer Law.

Customers remain responsible for maintaining appropriate backups of projects, presets, audio and other important data.

3.10 Governing law

For purchases made directly from Xenodimensional Audio, these terms are governed by the laws of Victoria, Australia , subject to any consumer rights or laws that apply and cannot legally be excluded.

4. Refund Policy Change-of-mind policy, faulty products, remedies and how to request a refund.

4.1 Change of mind

Because Xenodimensional Audio products are downloadable digital software, refunds are not provided simply because a customer changes their mind after purchase.

This includes situations where a customer:

  • decides they no longer want the plugin;
  • finds another product they prefer;
  • purchases the wrong product without any error in its description;
  • does not make use of the plugin after purchasing it; or
  • expected a feature that was not advertised as being included.

This change-of-mind policy does not limit any rights available under Australian Consumer Law.

4.2 Faulty or not fit for purpose products

If you believe a purchased product:

  • has a significant fault;
  • does not materially perform as described;
  • is not of acceptable quality;
  • cannot perform a purpose specifically represented by Xenodimensional Audio; or
  • otherwise fails to meet an applicable consumer guarantee,

please contact Xenodimensional Audio.

We may ask for reasonable information or evidence that allows us to understand and reproduce the problem.

This might include:

  • a description of the problem;
  • operating system version;
  • DAW and version;
  • plugin format;
  • steps required to reproduce the fault;
  • screenshots or screen recordings;
  • relevant crash reports or logs; or
  • other reasonable technical information relating to the problem.

We will not require unnecessary personal information merely to assess a refund request.

4.3 Remedies

Where reasonable evidence demonstrates that a product has a major failure , is materially not as described, is not fit for an expressly represented purpose, or otherwise gives rise to a right to a refund under Australian Consumer Law, Xenodimensional Audio will provide a refund where the customer is legally entitled to one.

Where a problem is minor and can reasonably be fixed, Xenodimensional Audio may first provide an update, replacement or other appropriate remedy as permitted by Australian Consumer Law.

Nothing in this Refund Policy removes or limits a customer's statutory rights.

4.4 Problems caused by the customer's system

A refund will not ordinarily be available where the software itself is not faulty and the problem results from matters such as:

  • use on an operating system that was clearly identified as unsupported;
  • use in an unsupported plugin format;
  • incompatible third-party software outside advertised compatibility;
  • modification or corruption of the software by the customer;
  • failure to meet clearly stated system requirements; or
  • misuse of the product.

This does not affect any rights that cannot legally be excluded.

4.5 Requesting a refund

Refund requests should be sent via the form on the contact page.

Please include:

  • your name;
  • purchase email address;
  • order or transaction number where available;
  • the product concerned; and
  • a description of the problem and relevant supporting information.

Refund requests will be assessed reasonably and in accordance with Australian Consumer Law.

If a refund is issued, the customer's licence for the refunded product ends and the customer must cease using and distributing any installed copies of that product.
